## About this tender

Der vorliegende Ausschreibungsgegenstand umfasst eine Konzession über Kommunikationsinfrastrukturen, welche unter die Bereichsausnahme nach § 149 Nr. 8 GWB fallen. Hieraus folgt, dass keine Bindung an das formale Vergaberecht einschließlich der Gewährung von Primärrechtsschutz besteht. Zur Gewährung eines transparenten und wettbewerbsfördernden Verfahrens wird sich bei der Verfahrensausgestaltung eng an den formellen Vorgaben des GWB und der KonzVgV bzw. VgV orientiert. Allein maßgeblich für die Verfahrensführung sind die Bestimmungen der Vergabeunterlagen sowie verfahrensleitende Anordnungen des Konzessionsgebers.
