The Guidance is supported by several background documents, including the Transgender International Research Literature Review 2021. In April 2025, the Supreme Court Ruling (For Women Scotland Ltd V The Scottish Ministers) ruled that, under the 2010 Equality Act, the protected characteristic of ‘sex’ means a person’s biological sex. The updated Equalities and Human Rights Commission Statutory Code of Practice for services, public functions and associations became legally binding on 5 August 2026 and provides guidance as to how the Equality Act 2010 should be applied. Following advice from legal counsel, and a literature review on the topic, the Sports Councils CEOs agreed that a full review is required. Sport England (on behalf of the Sports Councils) now seeks to appoint a supplier to review and revise the Transgender Inclusion in Domestic Sports Guidance from a scientific, medical and policy standpoint, to guide National Governing Bodies of sport (NGBs) and others in the sport sector to create transgender inclusion policies INSTRUCTIONS FOR INTERESTED PARTIES: To receive instructions on how to access the Procurement opportunity which is due to go live on 8th October 2026, please email on or before 7th October 2026.
