It is considered that this requirement can be placed using the Negotiated Procedure without Notice pursuant to Article 28(1)(e) of Directive 2009/81/EC (Regulation 16(1)(a)(i) (absence of suitable tenders) of the Defence and Security Public Contracts Regulations 2011. MTU are the Original Equipment Manufacturer (OEM) for the equipment and have an in-depth knowledge of the design, production processes, overhaul specifications, manuals and associated repair test schedules.
