# Incumbent supplier

The supplier currently delivering a contract, usually bidding to keep it when the buyer runs a new procurement.

Updated 14 Oct 2026

The incumbent is the supplier that currently holds a contract. When the buyer runs a new procurement for the same work, the incumbent usually bids to keep it, and other suppliers are competing to replace them.

## What it means

Incumbents tend to have real advantages: they know the buyer's people, the actual workload and the problems that never make it into a specification. The Procurement Act 2023 does not ban that advantage, but it limits how far it can tilt a competition:

- [Section 12(2) and (3)](https://www.legislation.gov.uk/ukpga/2023/54/section/12) require buyers to treat suppliers the same unless a difference justifies different treatment, and to take reasonable steps so that any different treatment does not put a supplier at an unfair advantage or disadvantage.
- [Section 16(3)](https://www.legislation.gov.uk/ukpga/2023/54/section/16) requires buyers running [preliminary market engagement](/glossary/preliminary-market-engagement) to make sure participating suppliers are not put at an unfair advantage and competition is not otherwise distorted.

The Act also makes incumbent performance more visible. For contracts worth more than £5 million, [section 52](https://www.legislation.gov.uk/ukpga/2023/54/section/52) generally requires at least three key performance indicators, and [section 71](https://www.legislation.gov.uk/ukpga/2023/54/section/71) requires the buyer to assess and publish performance against them at least once every 12 months.

## Why it matters for SMEs

Many SME bids are against an incumbent. Some buyers are happy with the current supplier; others want a change but need a credible, low-risk alternative. Your job is to be that alternative, without criticising a supplier the evaluators may have worked with for years.

## Practical tip

Before bidding, research the incumbent: how long they have held the contract, any published performance information and the buyer's comments in market engagement. Use [clarification questions](/glossary/clarification-questions) to ask for data the incumbent already knows, such as volumes or staff numbers. Then make your mobilisation plan concrete, because the biggest worry about switching is disruption. The [who won it](/tools/who-won-it) tool shows who holds contracts in your sector.
